Divorce is one of the hardest things a family goes through. You deserve a lawyer who listens, tells you the truth about your options, and fights for what matters most to you.

The basics in Indiana

  • Residency: one spouse must have lived in Indiana for 6 months, and in the county for 3 months, before filing.

  • No-fault: most divorces are filed on the ground that the marriage has broken down. You do not have to prove anyone did anything wrong.

  • 60-day minimum: a divorce cannot be final until at least 60 days after filing, even when both spouses agree on everything.

  • Temporary orders: while the case is pending, the court can set temporary custody, child support, and who stays in the home. It can also order that neither spouse hide or sell property.

Dividing property

Everything goes into one pot, including property from before the marriage and inheritances. The starting point is a 50/50 split. A judge can change that based on:

  • who contributed what

  • property brought into the marriage, inherited, or gifted

  • each spouse's financial situation, including who keeps the home with the children

  • wasting or hiding assets

  • earning ability

Spousal maintenance

Indiana limits spousal maintenance. A court can order it when a spouse is incapacitated, when a spouse must stay home to care for an incapacitated child, or for up to 3 years so a spouse can get training or education to re-enter the workforce. Spouses can also agree to other terms.

Your children

  • Custody is decided on the child's best interests. There is no presumption for mom or dad.

  • The judge looks at factors like the child's relationship with each parent, adjustment to home and school, and the child's wishes. The child's wishes carry more weight at 14 and older.

  • Since July 2025, judges must issue written findings in final custody orders.

  • Fathers deserve a voice. Mothers deserve a voice. I make sure the court hears yours.

  • In Marion County, divorcing parents must complete an approved parent education class.

Legal separation

If you are not ready to divorce, Indiana allows a legal separation of up to one year.

Attorney fees

In some cases, the court can order one spouse to pay part of the other spouse's attorney fees.
