Can you get a DUI while parked in Indiana? You can be charged. But Indiana calls it OWI, operating while intoxicated, and the State has to prove you operated the vehicle. Sitting in a parked car, even with the engine running, is not automatically operating.
What “operate” means
Indiana defines operate as to “navigate or otherwise be in actual physical control of a vehicle.” Ind. Code § 9-13-2-117.5. When a car is found sitting still with the engine running, whether the person in the driver’s seat operated it is a question of fact, decided from the surrounding circumstances. Mordacq v. State, 585 N.E.2d 22, 24 (Ind. Ct. App. 1992).
A running engine is not enough
Showing that someone started the engine is not enough to prove they operated the car. Hiegel v. State, 538 N.E.2d 265, 268 (Ind. Ct. App. 1989). In Hiegel, the driver was asleep in a tavern parking lot with the engine and heater running and the car in park, and the evidence was not enough to convict. In Mordacq, the driver was asleep in a car that had been running in the same spot for over an hour, and the court found no proof she was intoxicated when she last drove.
What courts look at
Where the car was. A parking spot is not a travel lane or a median.
Whether it was moving.
Whether anyone saw you drive it before police arrived.
The gear position. Park and drive point in different directions.
Courts also weigh any other evidence that supports a reasonable inference. Crawley v. State, 920 N.E.2d 808, 812 (Ind. Ct. App. 2010).
Timing matters too
The State has to prove you were intoxicated when you drove, not just when police found you. In 2026, the Court of Appeals reversed an alcohol-concentration conviction because the State had no evidence of when the defendant last drove. Stokes v. State, 274 N.E.3d 1278, 1283 (Ind. Ct. App. 2026).
How I defend it
The video. Body cam and dash cam show where the car was, the gear, the lights, and the keys.
The call. Who called police, and what they actually saw.
The timeline. When you stopped driving, when you were found, and when you were tested.
The reason you were there. Waiting out the cold or sleeping it off instead of driving.
Common questions
Can I get a DUI for sleeping in my car in Indiana? You can be charged. Whether it holds up depends on the facts above. In Indiana cases, sleeping in a parked car with the engine running, without more, has not been enough.
Does it matter if the keys were in the ignition? The keys, the engine, the lights, and the gear are all facts the court weighs together. No single one decides the case.
