Expunging an Arrest or Dismissed Case in Indiana
Never convicted? Your record can show it.
An arrest with no conviction can still show up on a background check. Indiana law lets you clear it, and in some cases the court is supposed to do it automatically.[1]

Cases the court should clear on its own
For charges filed after June 30, 2022, the court must order the records expunged when all charges are dismissed or you are acquitted. That order takes effect 60 days later, unless the prosecutor shows a reason to delay it up to one year.[1]
If your case was dismissed and it still shows up, the automatic order may not have been entered. We can check and file what is needed.
Arrests that never led to charges
For arrests after June 30, 2022, if a year has passed and no charges are pending, you can petition and the judge must order the arrest records expunged.[1] Expungement does not stop the prosecutor from filing charges later.[1]
Older arrests and other cases
You can petition one year after the arrest or charge, whichever is later, if it did not end in a conviction. The prosecutor can agree in writing to an earlier date.[1]
This also covers a case that ended only in an infraction, a conviction that was later vacated, and a conviction already expunged.[1]
Does this use up my one expungement?
No. The one-petition limit applies to conviction records, not to arrests and dismissed charges.[2]
