Expunging a Misdemeanor in Indiana

Five years can be enough.

Most misdemeanor convictions in Indiana can be expunged five years after the date of conviction. Once granted, the records are sealed from public view.[1] This includes a Level 6 or Class D felony that a court later reduced to a misdemeanor.[2]

When you can file

You can file five years after the conviction date. The prosecutor can agree in writing to an earlier date.[2]

What you need to show

  1. Five years have passed.

  2. No charges are pending against you.

  3. All fines, fees, court costs, and restitution are paid.

  4. No new convictions in the last five years.[2]

If a balance is the only thing holding you up, you may be able to pay it online through Indiana Courts ePay or your county clerk.

Who cannot use this path

People required to register as sex or violent offenders cannot. Neither can someone with two or more unrelated felonies involving unlawful use of a deadly weapon.[2]

Several misdemeanors?

You can clear more than one at the same time. All convictions from one county go in one petition, and you generally get one chance in your lifetime, so every case should be included.[3]
